Strong legal/regulatory signals: khata classification, layout approvals, registration hurdles and DRT (SARFAESI) procedure are central.

Many bank auction listings in Bangalore look cheap until the khata is examined. Properties with B-khata or on unapproved layouts form a noticeable part of the bank's non-performing stock in the city's outer growth belts. A B-khata tag can stop your registration, your home loan, or both, however low the reserve price is. So before you bid, confirm the khata type, the layout sanction and the conversion certificate, and then do the usual title and encumbrance checks.

The points below are specific to Bangalore: the areas where auction stock is found, what Karnataka stamp duty and the BBMP surcharge cost, how A-khata differs from B-khata and why that decides registration, and which DRT bench hears SARFAESI disputes from Karnataka.

Areas Where Bangalore Auction Listings Are Common

Most auction stock sits in IT-linked corridors, where home-loan volumes are high and layout regularisation trails construction. These include Electronic City, Whitefield, Sarjapur Road and the Hosur Road belt, along with newer outskirts such as Yelahanka and Devanahalli near the airport. Older layouts near Bommanahalli and Begur also see auctions, and they often have the same khata and conversion problems described below. Commercial and industrial lots are mostly found in the Peenya and Bommasandra industrial areas.

One pattern to keep in mind: the farther a property is from the established core wards of BBMP, the more likely it is on a layout approved by BDA or BMRDA, or on one with no approval at all. In Bangalore, layout approval is where auction risk mostly lies, more than in most other metros. Reserve prices in these corridors are usually 15-25% below market rates. Part of that gap is the khata and layout risk, not only the bank's wish to recover its money fast.

Stamp Duty and Registration Fee in Karnataka for Auction Purchases

  • Up to ₹20 lakh · Stamp duty: 2% · Registration fee: 1%
  • ₹21 lakh – ₹45 lakh · Stamp duty: 3% · Registration fee: 1%
  • Above ₹45 lakh · Stamp duty: 5% · Registration fee: 1%

Inside BBMP and other corporation limits, a surcharge and a cess are added to the duty. For costlier properties in BBMP limits, this takes the real rate above the 5% shown in the slab. Karnataka has changed these bands several times lately, so ask the sub-registrar for the current slab and surcharge before you bid. Duty is charged on the higher of two figures: your winning bid, which is the sale certificate value, or the government guidance value of the area. A cheap auction win can therefore still produce a large stamp-duty bill.

A-Khata and B-Khata: The Check That Decides Whether You Can Register

This is the most Bangalore-specific risk in this guide. A khata is the BBMP record that shows the owner is entered for property tax and that the property follows the sanctioned building plan and layout approval. An A-khata property is fully compliant. It can get a building licence, a new home loan and unrestricted registration. A B-khata property usually sits on an irregular converted layout, on revenue land, or has a gap in plan approval. It faces real limits: many banks refuse to lend against it, and some registration and licensing steps are blocked or made conditional, even if the owner can pay tax and hold a provisional khata extract.

BBMP has been moving these records to an online e-khata system, but a property being migrated does not change an underlying B-khata classification. Bank NPA stock includes many outer-area and irregular-layout properties. For that reason, khata status is a first check before any bid in Bangalore, along with title, and should never be left for later.

  • Property tax record · A-Khata: Entered in BBMP's main (A) register · B-Khata: Entered in BBMP's separate "B" register
  • Layout/building-plan approval · A-Khata: Sanctioned and in compliance · B-Khata: Irregular, unapproved, or converted but not compliant
  • Fresh bank home loan · A-Khata: Usually possible · B-Khata: Frequently refused or given with heavy conditions
  • BBMP building licence · A-Khata: Obtainable · B-Khata: Normally blocked until the khata is upgraded to A
  • Registration at auction · A-Khata: No difficulty · B-Khata: Usually possible, but the limits above follow later

Request the khata extract from the auctioning bank at the start, then verify it yourself at the BBMP ward office before bidding. The description in the auction notice is not enough.

BBMP Tax Arrears, Conversion Orders and the RTC

As with municipal dues in other cities, unpaid BBMP property tax generally stays with the property and does not remain with the defaulting borrower. Obtain a current tax-paid receipt and a dues statement from BBMP itself before you bid. For outer-area properties, also check whether the land has a valid conversion certificate under the Karnataka Land Revenue Act, which changes its use from agricultural to non-agricultural. Land that was never converted appears as agricultural in the RTC (Record of Rights, Tenancy and Crops). That entry alone can block registration or later development, whatever has been built on the plot.

Which Authority Approved the Layout: BDA or BMRDA

In the urban core of Bangalore, layouts are normally approved by the Bangalore Development Authority (BDA). Layouts in the wider surrounding region come under the Bangalore Metropolitan Region Development Authority (BMRDA). The approving authority, and whether its sanction is still valid, affects khata eligibility, utility connections and the later approval of building plans. Check the authority and the layout approval number on your own, and do not rely on how the auction notice describes them. For a BDA layout, the sanction number and site plan can be searched at the BDA office for that zone. For a BMRDA layout, ask BMRDA directly for the approval order, because these outer-region sanctions are digitised much less consistently than BBMP's records.

Debt Recovery Tribunal Bengaluru and Karnataka Auction Disputes

The Debts Recovery Tribunal in Bengaluru hears SARFAESI actions by banks and challenges by borrowers for Karnataka properties. Appeals go to the DRAT. As elsewhere, a borrower may file a Section 17 application about valuation, notice or procedure after you win the bid and before the balance payment is due. Search the tribunal's cause list for the property and the borrower's name before you pay the EMD, and again before the final payment.

Where LegiScore Fits In

Khata type, layout sanction, conversion certificate, BBMP dues and a search for DRT filings are five separate lookups. Most buyers do not finish all five before bidding, and this is where Bangalore auction risk is hidden. Each listing in our bank auctions marketplace has an independent LegiScore Property Score (LPS) on a five-tier scale from AAA to C. It is scored out of 1000 across five pillars: Title Integrity (300 points), Encumbrance & Financial (250), Litigation (200), Regulatory Compliance (150), which is where khata and layout-approval status are flagged, and Document Completeness & Integrity (100).

To check a Bangalore property yourself, LegiScore searches 70+ government portals and 100+ court databases across 700+ district and high courts in 14 states. It returns a 29-section report in under 15 minutes, after 3 human checkpoints, and a signed opinion from a licensed advocate can be added. Frequently asked questions

Is it possible to buy a B-khata property in a Bangalore bank auction?
Yes, you can bid, but expect problems afterwards. Many lenders will not finance a B-khata property, and registration or later building approvals may be blocked or made conditional. Confirm the khata type before bidding and not after, since the discount on B-khata stock often reflects exactly this risk.
How is A-khata different from B-khata in Bangalore?
With A-khata, BBMP has confirmed that the property follows the sanctioned layout and building plan and that the owner is correctly entered for property tax. Loans and registration face no restriction. B-khata is given to properties on irregular, unapproved, or converted but non-compliant layouts. It brings financing and approval limits even when the owner is able to pay property tax.
How much stamp duty applies to a Bangalore auction purchase?
Karnataka charges 2% up to ₹20 lakh, 3% for ₹21-45 lakh, and 5% above ₹45 lakh, along with a 1% registration fee. Inside BBMP and other corporation limits, a surcharge and cess are added to the duty. Ask the sub-registrar for the current effective rate before you bid.
Which tribunal handles disputes over Bangalore auction properties?
The Debts Recovery Tribunal in Bengaluru hears SARFAESI actions and borrower challenges for Karnataka properties, and appeals go to the DRAT. Look at the cause list before you bid and once more before you make the final payment.
Why is khata trouble so common in Bangalore auction listings?
Bank NPA stock leans towards the outer growth corridors: Electronic City, Whitefield, Sarjapur Road, Yelahanka and Devanahalli. In these areas layout regularisation and khata status often trail actual construction. A good share of auction properties therefore have B-khata or missing conversion certificates.
Do BBMP property tax arrears pass to the buyer of an auctioned property?
In practice, yes. Unpaid BBMP tax stays attached to the property and not to the earlier owner. Get a current tax-paid receipt and dues statement from BBMP before you bid.
