A home-loan legal check in Goa is the lender's review of the title deeds, Form I & XIV or Form D, encumbrances and approvals before it releases a loan. The encumbrance check is a Nil Encumbrance Certificate from the Sub-Registrar, based on the mortgage index.
Definition
Nil Encumbrance Certificate: A certificate from the Civil Registrar-cum-Sub-Registrar that no mortgage is recorded against the property in the office's mortgage index for the years searched.
When you need it
Before the bank sanctions or disburses a home loan, and ideally before you sign an agreement, so that title problems surface early.

- Get a current Form I & XIV (or Form D) and the survey plan from Goa Online.
- Apply for a Nil Encumbrance Certificate at the Sub-Registrar for the years the lender asks for.
- For a new flat, check the project on Goa RERA.

Questions
- How long does an encumbrance certificate take?
- The Registration Department says certificates normally take 3 to 15 days, depending on the office.
- Does a Nil Encumbrance Certificate show court cases?
- No. It is a search of the Sub-Registrar's mortgage index. Court cases and revenue disputes need separate checks.
- Which land record applies in city areas?
- In the city survey areas of Panaji, Margao, Mapusa and Vasco, the record is Form D instead of Form I & XIV.
- How do I get copies of old deeds?
- Apply for a certified copy through NGDRS-Goa and collect it at the Sub-Registrar office with a Rs 50 non-judicial stamp paper.
